Although this\ndirective will not cause a landslide, with its article <em>minus 14 <\/em>it does oblige European Member States to better protect\nauthors and performers against the online exploitation of their works and\nperformances. The principle of an appropriate and proportional remuneration\nbecomes the rule, a lump sum buyout the exception.<\/strong><\/p>\n\n\n\n<script id=\"infogram_0_fabc46d3-541a-4efa-bd28-0ec316c1b4a9\" title=\"Article -14\" src=\"https:\/\/e.infogram.com\/js\/dist\/embed.js?Rcj\" type=\"text\/javascript\"><\/script>\n\n\n\n<p class=\"wp-block-paragraph\">When, at\nthe end of 2016, the European Commission announced its initiative for a reform\nof copyright and related rights, it was a major disappointment for performers.\nAfter all, more than a few transparency measures were not foreseen. The\nCommission identified musicians and actors as the weaker party in negotiating\nan agreement, but the real strengthening of their negotiating position was not\non the agenda.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The fact\nthat the proposal was subject to a great deal of lobbying and media-attention\nis due to its notorious <strong><em>article 13<\/em><\/strong>. This aims to equate\nlarge platforms like YouTube and Facebook to other users of protected content\nand to oblige them to compensate music- and filmmakers. And not everyone was equally\nhappy with that.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In order to\nbuild a platform, you have to be able to bring people together. The more people\nyou bring together, the more lucrative your platform becomes. And where a\nplatform like wikipedia does with knowledge, YouTube and Facebook do that\nmainly with music and audiovisual content. There is no doubt that the music\nindustry and the audiovisual industry are suppliers of content to these\nplatforms, but they do not equally share in the profits made by the platforms. This\nhas led to what is called the <strong><em>value gap<\/em><\/strong>. It therefore seems no\nmore than fair that they would be obliged to enter into agreements with their main\nsuppliers so that these can be remunerated correctly for their services.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The\nintention to end the <em>value gap<\/em> has\nled to endless discussions and particularly delayed the adoption of this\ndirective. However, despite the announcement of the end of the internet and the\nloss of the freedom of speech, the principle of platform liability in the current\ntext remained unchanged. And that&rsquo;s a good thing. After all, it means proper revenue\nfor the audiovisual and the music industry.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But Article\n13 does not change much to the existing distribution of resources within those industries.\nThere is also a value gap between the producers and the actors and musicians\nwhose performance they exploit. In order to offer a solution to this reality,\nParliament added an <strong><em>article minus 14<\/em><\/strong> in its own proposal. This article obliges\nEuropean member states to guarantee that musicians and actors receive <strong>appropriate<\/strong> and <strong>proportionate remuneration<\/strong> for the exploitation of their\nperformances: regardless of offline and online.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It may seem\nobvious, but this small article offers many opportunities for developing a\ncorrect remuneration system for online exploitations. It ensures that <strong>lump sum buy-outs of actors and musicians\ncan no longer be the rule<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A principle\nagreement &ndash; between representatives of the various European institutions: the\nCommission, the Council and the Parliament &ndash; on a compromise text, <em>including<\/em> article <em>minus 14<\/em>, was reached on <strong>13\nFebruary 2019<\/strong>. This text only needs to be approved by the plenary\nParliament and that is scheduled for the end of this month. It is then up to\nthe Member States of the EU to work on a new system that guarantees performers\nan <strong>appropriate<\/strong> and <strong>proportionate remuneration<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To be continued!<\/p>\n\n\n\n<p style=\"background-color:#54beba;color:#ffffff\" class=\"has-text-color has-background wp-block-paragraph\"><strong>How does a European directive come about? <br><\/strong>To understand that quickly, you need to know that three institutions are involved in the European decision-making process: the Commission (the European government), the Parliament (representing citizens) and the Council (representing the Member States).  <br>The initiative always comes from the Commission. She makes a <em>proposal for a directive<\/em>. The Parliament and the Council will then work on this proposal. Once they agree on their <em>&lsquo;position&rsquo;<\/em> on the Commission&rsquo;s proposal, the Parliament and the Council will each appoint a negotiator who will negotiate a <em>compromise text<\/em> with the Commission. These negotiations are called <em>the<\/em> <em>trilogues<\/em>.  <br>If the trilogues lead to a compromise text, it must first be approved by the Council and the plenary Parliament before one can really speak of &lsquo;the directive&rsquo;. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n","protected":false},"excerpt":{"rendered":"<p>With only the approval of Parliament to go, the long-fought Copyright Directive seems to reach its end point.
