Not only was the highly anticipated&nbsp;<strong>Copyright Directive<\/strong>&nbsp;approved, also the planned adjustments to the&nbsp;<strong>Satellite and cable directive<\/strong>&nbsp;were accepted. We briefly explain what changed for performers in Europe this week.<\/p>\n\n\n\n<p>On&nbsp;<strong>Tuesday,\nMarch 26<\/strong>, the&nbsp;<strong>Copyright Directive<\/strong>&nbsp;was voted, the directive that will go down\nin history as the most disputed and mediatised directive of the European Union\never. And this mainly because of the notorious&nbsp;<em><strong>Article\n13<\/strong><\/em>&nbsp;that some\npeople announced as the end of the internet, the end of freedom of speech. The\narticle, however, only states that large online platforms, such as YouTube and\nFacebook, may now be considered&nbsp;<strong>users<\/strong>&nbsp;of music and audiovisual works. That\nturned out not to be the case under the current Copyright Directive, which\ndates back to 2001, when YouTube and Facebook had not yet seen the light. Even\nMyspace did not exist yet at that time. It was, therefore, about time to adapt\nthe copyright and neighbouring rights rules to this new digital era.<\/p>\n\n\n\n<p>Even more\nimportant than closing the so-called&nbsp;<strong>value gap<\/strong>, is the\nintroduction of the general principle that authors and performers artists are at\nall times entitled to&nbsp;<strong>an appropriate and proportionate remuneration<\/strong>&nbsp;for any type of exploitation, including\nonline. And that does not only apply to our new users, but also to our existing\nusers such as Spotify, Netflix and other online operators, because there, too,\na redistribution of resources is necessary. To safeguard that, the directive\nalso provides increased transparency obligations for producers and other users\nand even the possibility of reopening a bad deal. For example, if you, as a\nmusician or actor, have accepted a flat-rate buy-out for a recording that,\nnevertheless, generates great commercial success, you are now entitled to\ndemand an additional remuneration.<\/p>\n\n\n\n<p>The amendment\nto the&nbsp;<strong>SatCab directive<\/strong>&nbsp;was approved on&nbsp;<strong>Thursday,\nMarch 28<\/strong>. And here the need for an update to the current\ndigital era was even more urgent than for the Copyright directive. In fact, the\nexisting rules for the television market date back to 1993, when there were\nonly just a few commercial broadcasters active, and when there was no digital\ntelevision yet, let alone, online television transmission.<\/p>\n\n\n\n<p>With this&nbsp;<strong>Directive\non online transmission<\/strong>, Europe offers its broadcasters more\noptions to transmit their programs via the internet and to offer its viewers\nthe options of catch-up and other forms of postponed viewing. By applying the <em>country of origin<\/em> principle to the\ninternet, broadcasters must also no longer use geo-blocking to prevent their\nbroadcasts from being watched via the internet in all European member states. This\nis allowed now and no additional contracts in every country are needed anymore.\nOf course, this only applies to the broadcasters <em>own programs<\/em>, and not to independent films and series. Hence, a\nlittle geo-blocking will continue to exist.<\/p>\n\n\n\n<p>New rules have also\nbeen installed for the distributor&rsquo;s market. Offering&nbsp;<strong>television\npackages via the internet<\/strong>&nbsp;(e.g.\nStievie) will be made easier by making collective management mandatory here, as\nwell.<\/p>\n\n\n\n<p>Finally, the\ndirective itself offers a solution for the notorious&nbsp;<strong>direct\ninjection<\/strong>. In Belgium, this issue has only very recently been\nsolved. Europe now obliges all Member States to provide a solution based on the\nassumption that both broadcasters and distributors have a responsibility and\nthat both are, therefore, obliged to remunerate the makers.<\/p>\n\n\n\n<p>PlayRight has\nclosely followed up on the drafting of these directive and will continue to\naccurately monitor their transposition into Belgian legislation. We will ensure\nthat this strong signal of Europe to offer musicians and actors more favorable\nposition within the online market does not remain a dead letter.<\/p>\n\n\n\n<p>To be\ncontinued.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>It was a busy week for Europe.
