{"id":1999,"date":"2018-08-14T10:30:30","date_gmt":"2018-08-14T10:30:30","guid":{"rendered":"http:\/\/playright.be\/prestation-artistique-protegee-par-les-droits-voisins\/"},"modified":"2019-06-14T09:25:51","modified_gmt":"2019-06-14T09:25:51","slug":"artistic-performance-protected-by-neighbouring-rights","status":"publish","type":"post","link":"https:\/\/playright.be\/en\/artistic-performance-protected-by-neighbouring-rights\/","title":{"rendered":"Neighbouring rights of performers"},"content":{"rendered":"<p><strong>When a performer \/ performing artist <\/strong>(musician, actor, dancer, vaudeville or circus artist) takes part in<strong> the performance of a work, <\/strong>and if that performance is<strong> recorded <\/strong>and then broadcast or copied<strong>, the artist in question is entitled to a fee. <\/strong>In other words, the artist acquire a <strong>neighbouring right<\/strong> at the moment of the <strong>performance<\/strong>.<\/p>\n<p>The law has introduced a number of criteria to determine whether your <strong>performance<\/strong> is regarded as the achievement of a performer. The work must be eligible for copyright and it must be performed through:&nbsp;<\/p>\n\n\n<ul class=\"wp-block-list\"><li><strong>song<\/strong><\/li><li><strong>recital<\/strong><\/li><li><strong>declamation<\/strong><\/li><li><strong>staging<\/strong><\/li><li><strong>presentation<\/strong><\/li><li><strong>dance or<\/strong><\/li><li><strong>play.<\/strong><\/li><\/ul>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img decoding=\"async\" width=\"768\" height=\"640\" src=\"http:\/\/playright.be\/wp-content\/uploads\/2018\/08\/neigbouring_rights-768x640.png\" alt=\"Neighbouring rights\" class=\"wp-image-7080\" srcset=\"https:\/\/playright.be\/wp-content\/uploads\/2018\/08\/neigbouring_rights-768x640.png 768w, https:\/\/playright.be\/wp-content\/uploads\/2018\/08\/neigbouring_rights-300x250.png 300w, https:\/\/playright.be\/wp-content\/uploads\/2018\/08\/neigbouring_rights-1920x1600.png 1920w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/figure><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\n\nWhichever way you perform the work, your contribution will be deemed to be an <strong>artistic performance<\/strong> once it meets any one of the above criteria.\n\n<\/p>\n\n\n\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-text-color has-background has-pr-green-background-color\" href=\"\/en\/how-to-join-playright-as-a-member\/\" style=\"color:#ffffff\"><strong>How to become a member<\/strong><\/a><\/div>\n\n\n\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link has-pr-green-background-color has-text-color has-background\" href=\"https:\/\/portal.playright.be\/MembershipMng\/PlayRightRegistration2.aspx\" style=\"color:#ffffff\" target=\"_blank\" rel=\"noreferrer noopener\"><strong>Become a member<\/strong><\/a><\/div>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Not all artistic performances qualify. <\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>The services of a sculptor for instance, even though undeniably artistic, are not eligible as they are not associated with the performance of a work but with its creation. <\/li><li>Likewise, the services furnished by an artistic producer or a studio engineer are also disqualified because they are linked to the recording of the performance and do not form part of the performance itself.<\/li><li>The services provided by additional artists (camera crew, extras, etc&#8230;.) are not covered by the legal concept of &#8220;performance of a performing artist&#8221; either. <\/li><li>Sport performances or informative services as provided by presenters or newsreaders are not protected by neighbouring rights either.<\/li><\/ul>\n","protected":false},"excerpt":{"rendered":"<p>What are neighbouring rights?
