With the publication on 13 March 2023 of a first Royal Decree on the functioning of the Kunstwerkcommissie, the criteria and procedure for the recognition of arts federations and the improvement of social protection for arts workers, we know more about the first practical applications of this new framework applicable to performers, among others. Here is a quick overview of the most important elements!   <\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li><span class=\"TextRun SCXW3168723 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><strong><span class=\"NormalTextRun SCXW3168723 BCX0\">A new procedure to qualify for the special<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW3168723 BCX0\">benefit<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW3168723 BCX0\">scheme for artists&nbsp;<\/span>&nbsp;<\/strong><\/span><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">A new &ldquo;Commission du Travail des Arts&rdquo; or &ldquo;Kunstwerkcommissie&rdquo; (Arts Labour Commission) will replace the &ldquo;Commission Artistes&rdquo;\/&rdquo;Commissie Kunstenaars&rdquo; (Artists Commission) and will be responsible for granting 3 types of attestations of the arts worker that will allow the holder to invoke all the specific rules applicable to arts workers but also the future rules that will be created for them:   <\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>&ldquo;CLASSIC&rdquo; attestation<\/strong> (Validity period: 5 years, renewable): this attestation can be obtained by the worker who brings proof of &ldquo;a professional artistic practice in the arts&rdquo;. The fields covered are audiovisual arts, plastic arts, music, literature, performance, theater, choreography and comics.  <\/li>\n\n\n\n<li><strong>&ldquo;PLUS&rdquo; attestation <\/strong>(valid for 5 years, renewable): this certificate may be granted to artists who demonstrate a minimum gross income over a certain period. Why &ldquo;plus&rdquo;? Because it gives the right to the holders of this certificate to claim the application of the rule of the &ldquo;statute of the artist&rdquo; namely a system of specific allowances for the worker of the arts. If you have the &ldquo;PLUS&rdquo; certificate and can prove that you have worked 156 days as an employee over a period of 24 months (or 11,274.12 &euro; gross), you can benefit from this system, its rate and its non-degressive rules.   <\/li>\n\n\n\n<li><strong>&ldquo;<span class=\"TextRun SCXW37184268 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW37184268 BCX0\">BEGINNER&rdquo; attestation <\/span><\/span><\/strong><span class=\"TextRun SCXW37184268 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><span class=\"TextRun SCXW37184268 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\">(Validity<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">period: 3 years, non-renewable):<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">this<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">certificate<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">concerns a &ldquo;beginner&rdquo; worker<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">who has a diploma of higher<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">artistic<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">education or who has equivalent training\/work<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">experience in an arts sector<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">mentioned in the decree. In order to qualify, the worker must be &ldquo;either in possession of a career or business plan or in the process of undergoing training to develop<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">such a plan.&rdquo; In addition, he or she must be able to prove<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">that<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">he or she has either<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">performed at least 5 artistic performances or obtained a gross<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">income of 300 euros &ldquo;in the so-called main activities<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">during the 3-year period<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">preceding the application&rdquo;. These<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">rules are therefore more flexible than<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">those for the other<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">two types of attestations, the objective being to support &ldquo;beginners&rdquo; who are starting out in the cultural sector. In terms of content, this attestation also<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">makes<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">it possible to claim the rule of &ldquo;artist<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW37184268 BCX0\">status&rdquo; (the benefits of the artist, editor&rsquo;s note).&nbsp;&nbsp;<\/span>&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">What will be the procedure for obtaining these certificates?    <\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span class=\"TextRun SCXW101182871 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW101182871 BCX0\">The application will<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW101182871 BCX0\">be made electronically via the platform <a href=\"https:\/\/www.workinginthearts.be\/\">https:\/\/www.workinginthearts.be\/<\/a>. The actual<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW101182871 BCX0\">opening date of the section dedicated to applications for certificates<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW101182871 BCX0\">is not yet<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW101182871 BCX0\">known.&nbsp;&nbsp;<\/span>&nbsp;<\/span><\/li>\n\n\n\n<li>The Commission, composed of 50% artists and representatives of the cultural sector (a much better representation than in the past!), will analyze the &ldquo;artistic and &ldquo;necessary&rdquo; character of the services performed by the worker, as well as the fact that the volume of these services demonstrates the main activity of the worker:   <\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"1\">\n<li>&ldquo;Artistic and necessary&rdquo;: That the services relate to one of the arts listed in the legislation and that &ldquo;without them, the same artistic result could not be obtained.&rdquo;  <\/li>\n<\/ol>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li>&ldquo;Main Activity&rdquo;: That the volume of activities is representative of the fact that the services submitted constitute a main professional activity.  <\/li>\n<\/ol>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If this volume corresponds to an amount greater than 65,400&euro; gross over the 5-year period, this criterion will automatically be met.   <\/li>\n\n\n\n<li>If it represents between 1,000&euro; gross and 65,400&euro; gross over the 5-year period, the Commission will look at other elements to verify that the income generated can cover part of the subsistence needs or that the artistic work represents a significant part of the professional time investment.  <\/li>\n\n\n\n<li>If this represents less than 1,000 &euro; gross over the last 2 years preceding the application, the file will be refused. <\/li>\n<\/ul>\n\n\n\n<ol class=\"wp-block-list\" start=\"2\">\n<li><span class=\"TextRun SCXW27236307 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><strong><span class=\"NormalTextRun SCXW27236307 BCX0\">An increase in the stacking<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW27236307 BCX0\">limit<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW27236307 BCX0\">between<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW27236307 BCX0\">authors&rsquo; rights\/neighboring<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW27236307 BCX0\">rights and arts worker<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW27236307 BCX0\">allowances&nbsp;<\/span>&nbsp;<\/strong><\/span><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Good news! The possibility of cumulating author&rsquo;s rights (and neighbouring rights) with arts allowances has been doubled and will amount to 10.420,80&euro; net taxable per year. Below this amount, there will be no impact on what the arts worker will receive as allowance.   <\/p>\n\n\n\n<ol class=\"wp-block-list\" start=\"3\">\n<li><span class=\"TextRun SCXW254791620 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><strong><span class=\"NormalTextRun SpellingErrorV2Themed SCXW254791620 BCX0\">Transitional<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW254791620 BCX0\">measures<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW254791620 BCX0\">from &ldquo;artist<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW254791620 BCX0\">status&rdquo; to &ldquo;arts worker<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW254791620 BCX0\">status&nbsp;<\/span>&nbsp;<\/strong><\/span><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><span class=\"TextRun SCXW118861704 BCX0\" lang=\"FR-FR\" xml:lang=\"FR-FR\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW118861704 BCX0\">The new <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">procedure<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">will<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">take<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">effect<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> no <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">later<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">than<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">January<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> 1, 2024 or as <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">soon<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> as the new Arts Labour Commission <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">is<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> in place. In the <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">meantime<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\">, <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">transitional<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">measures<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> have been in <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">effect<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">since<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">October<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> 1, 2022 for performers <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">who<\/span> <span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">did<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> not have the <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">benefit<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> of the freeze on <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">degressivity<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> at <\/span><span class=\"NormalTextRun SpellingErrorV2Themed SCXW118861704 BCX0\">that<\/span><span class=\"NormalTextRun SCXW118861704 BCX0\"> time.
