FIRST DISTRIBUTION AUDIOVISUAL RIGHTS 2019: 275.000€

PlayRight has carried out the first distribution of audiovisual rights generated by the works that were broadcast in Belgium in 2019. We distributed no less than 275.000€ amongst our actors and actresses! The audiovisual rights 2019 will be closed with a second, final distribution in 2024.

The remunerations of these rights stem from the private copying and the lending right.

FIRST/FINAL DISTRIBUTION: HOW DOES IT WORK?

PlayRight distributes your rights for a reference year in two steps: an first distribution and a final distribution.

The first distribution sets the deadline for declarations of the recordings that may generate rights for the reference year 2019. After this deadline it is no longer possible to declare your performances for these reference years. A non-declared repertoire, hence, will not generate neighbouring rights.

This distribution is based on your declared repertoire as registered in our database. If you still have recordings to declare for this period, you have until the 31/12/2023 to do so.

HOW ARE MY RIGHTS CALCULATED AND, CONSEQUENTLY, DISTRIBUTED?

To calculate your rights for audiovisual performances, a global amount of rights is allocated to each audiovisual work that appears in the playlists.

This amount is determined based on:

  • the duration of the work,
  • the time of broadcast
  • and the market share of the channel.

The total amount allocated to a work is then divided amongst the performing artists who have participated, depending on their role on that recording.

Note that as of this first distribution of audiovisual rights generated in 2019, there are only two roles that can be attributed to your performance (before this, PlayRight offered three choices of roles). This change was made following the adoption of new general regulations.

For this distribution, the Board of Directors has established a list of selected channels as well as a minimum audience rate to be reached for each program.

CAUTION:

Music performances in an audiovisual recording might also generate neighbouring rights. In other words, a musician can also generate audiovisual rights for the inclusion of his or her music in a work, provided that the music was performed specifically for the audiovisual work in question.
